Terms of Use

These terms of use(”Terms of Use”) apply to the online timed-entry ticket sales (“the Service”) provided by the Nezu Museum (“the Museum,” “we,” “us,” “our,” etc.).

Article 1. Applicability

  1. 1. The Terms of Use apply to all relationships concerning the use of the Service between the Museum and visitors who wish to use the Service.
  2. 2. Visitors who use the Service are responsible for faithfully abiding by the Terms of Use, the socially accepted manners and ethics for internet use, and technical rules.
  3. 3. Our Privacy Policy (https://www.nezu-muse.or.jp/en/privacy-policy) applies to the handling of personal information that the Museum collects from visitors in connection with the Service.

Article 2. Usage Environment

  1. 1. The visitor is responsible for providing the necessary communications device, software, internet connection, etc., to use the Service, at his or her own expense, and carrying out the appropriate settings for text (displayed in Japanese or English) and email. The Museum is not liable for any resulting outcomes or effects if these conditions are not met.
  2. 2. The Museum is not liable for any resulting effects if the Service does not operate properly due to the visitor’s operating system, software, LAN environment, or other factors, despite the visitor’s having met the conditions stated in the paragraph above.
  3. 3. The visitor shall pay any communication fees, connection fees, or other charges arising in connection with his or her use of the Service.

Article 3. Completion of the Museum Ticket Purchase Agreement

  1. 1. The visitor may use the Service to apply to purchase a timed-entry ticket to an exhibition organized by the Museum. The Terms of Use apply to requests for tickets by a visitor who can enter the Museum for free because the visitor has a membership recognized by the Museum, such as the Nezu Club, or has an invitation postcard or letter.
  2. 2. The visitor will, when using the Service, follow the instructions on the website operated by the Museum and used for the Service (the “Website”), accept the Terms of Use, and accurately input the necessary information to complete the purchase, as specified in Article 5 below, and provide the email address at which we can contact the visitor about the purchase (collectively, “Purchase Information”). If the Purchase Information input is incorrect, the application to purchase a ticket will be invalid.
  3. 3. The Museum is not liable and will not refund payments if the visitor makes duplicate applications for tickets due to his or her input errors or problems in his or her communications environment.
  4. 4. Since this is a real-time purchasing system using the internet, internet congestion or computer system problems may cause substantial delays or make it impossible to determine the success or failure of the purchase or send notification of its completion.
  5. 5. The Museum is not liable, to the visitor or a third party, concerning the success or failure of the purchase under the conditions specified in the previous paragraph.
  6. 6. The type and price of the timed-entry ticket that visitors can purchase using the Service are as stated on the Website. The types and prices for timed-entry tickets are subject to change at the Museum’s discretion, without prior notice.
  7. 7. The purchase agreement for a timed-entry ticket made through the Service is concluded when the procedure for purchasing the timed-entry ticket is completed on the Website. When a visitor is notified on the Service’s ticket sales page of the completion of the purchase procedure, the transaction is deemed complete. The above does not apply, however, if the credit card company informs us that it rejects the visitor’s payment.
  8. 8. Should an unlawful or inappropriate action concerning the use of the Service occur, the Museum may void or cancel the purchase agreement and/or take other suitable measures.
  9. 9. After the purchase agreement made with the Service is concluded, a notification of the completion of the purchase will be shown on the Service’s ticket sales page and an email notifying the visitor of the completion of the purchase (“Purchase Completion Notification Email”) will be sent to the visitor based on the Purchase Information. The Museum shall not be liable, however, should the Purchase Completion Notification Email not reach the visitor, be delivered to an incorrect address, or be delayed, for example, due to an error in the email address information provided, an encoding error corrupting the text, or other problems with the notification, and the visitor cannot confirm the completion of the purchase.
  10. 10. Sales of the timed-entry tickets being handled by the Service will cease when the maximum number of ticket sales has been reached, even if the sales period had been stated to last longer. Ticket sales will resume, however, if the exhibition period is extended, for example.
  11. 11. A minor must have his or her parent’s or guardian’s permission to use the Service. For use of the payment part of the Service, a minor must have the parent’s or guardian’s agreement to all items.
  12. 12. The Service cannot be combined with the use of discount coupons unless the Museum provides otherwise.

Article 4. Changes in or Cancellation of a Ticket

When a timed-entry ticket purchase agreement has been completed, as specified in the article above, changes or cancellations by the visitor will not be accepted for any reason. There is no cooling-off period for the timed-entry tickets provided by the Service.

Article 5. Ticket Fee Payment

  1. 1. The visitor using the Service to purchase a timed-entry ticket will pay the ticket fee plus any other fees required to complete the transaction (“ticket fees, etc.”). Payments will be made as explained in the next paragraph.
  2. 2. Payment for timed-entry tickets purchased through the Service must be made by a credit card issued in the name of the visitor or any other payment method the Museum may specify from time to time. As specified in Article 3 above, the payment method cannot be changed after the completion of the timed-entry ticket purchase.
  3. 3. Payment by credit card will be made immediately upon completion of the timed-entry ticket purchase, following the terms of the contract between the visitor and the credit card company. Should a dispute arise between the visitor and the credit card company, it shall be resolved by the parties concerned; the Museum shall not be liable for resolving the dispute.
  4. 4. If payment of the ticket fee cannot be confirmed after the deadline for payment determined by the Museum, despite completion of the purchase agreement, the Museum may cancel the purchase agreement and refuse to allow the visitor in question to use the Service in the future.
  5. 5. By using the Service, the visitor acknowledges the risk of leakage of information that accompanies payment methods that involve the transmission of credit card numbers and agrees to transmit that information at his or her own risk.
  6. 6. The Museum has no responsibility for problems in payment by credit card or in the use of other payment methods the Museum may specify.
  7. 7. The Museum can, by notifying or informing the visitor in advance by a method it deems suitable, add to or change ticket fees or payment methods.

Article 6. Issuance of a Timed-Entry Ticket and Entry into the Museum

  1. 1. When the visitor arrives at the Museum at the date and time specified on the timed-entry ticket, he or she will show the Museum staff the QR code attached on the timed-entry ticket displayed on the URL in the Purchase Completion Notification Email (the”Entry QR Code”). A staff member will use a scanner to read the QR code. Only when the code can be read will the visitor be allowed to enter the Museum. Should the scanner not be working properly, visitors will follow Museum staff members’ directions concerning entry procedures.
  2. 2. The entry procedures require that the visitor present a printout (made on a home or other printer) of the Entry QR Code or display the Entry QR Code on the screen of a smartphone or other electronic device.
  3. 3. If the visitor has chosen the “Discount” or free “Member or Invited” category when purchasing his or her ticket, he or she must show the Museum staff member, along with the Entry QR Code, the ID or other documents that certify eligibility for the “Discount” or free “Member or Invited” category. Failure to present appropriate certification will invalidate the discounted or free admission, and the visitor must pay the regular admission fee in full, including the difference between the discounted and regular admission fee.
  4. 4. If the visitor does not bring a printout of the Entry QR Code to the museum, does not bring an electronic device to display the Entry QR Code, or cannot display the Entry QR Code on it to a Museum staff member because its battery is dead, for example, the visitor will not be admitted to the Museum.
  5. 5. The Museum has no responsibility for problems due to the visitor, including a malfunction of the visitor’s electronic device or loss of the Purchase Completion Notification Email or printout of the Entry QR Code.

Article 7. Responsibility for managing the entry QR codes and other entry tickets

  1. 1. If two persons arrive at the Museum with the same Entry QR Code, only the first person whose Entry QR Code is read by the scanner at the entrance to the Museum can be admitted.
  2. 2. If the visitor knows that his or her Entry QR Code has been stolen or is being used by a third party, he or she should contact the Museum immediately and follow any instructions the Museum may provide.
  3. 3. It is the visitor’s own responsibility to manage the Entry QR Code (including, but not limited to reprints or copies of it). The Museum will not reissue the Entry QR Code. The Museum will not be liable for any conflict, dispute, or damage caused by a third party’s usage of the Entry QR Code, including the case specified in Section 1 of this Article, regardless of whether it results from the visitor’s accidental or deliberate actions or not.

Article 8. Prohibited Actions

  1. 1. The visitor must not perform any of the actions described below in using the Service. Visitors are liable for harm to the Museum or to other visitors or a third party resulting from any actions specified below.
    1. a. Purchasing a timed-entry ticket for the purpose of reselling it to a third party or providing it to a third party for resale;
    2. b. Reselling or attempting to resell a timed-entry ticket to a third party, or reselling or attempting to resell it at an auction or online auction, regardless of the objective;
    3. c. Any actions that violate the Terms of Use;
    4. d. Use of the Service by using an electronic device that belongs to someone other than the visitor or was acquired by improper means or by misusing a credit card;
    5. e. Actions in violation of laws and regulations or public order and morals;
    6. f. Reproducing (by copying or other means), duplicating, forwarding, transferring, circulating, distributing, selling, etc., information the Museum provides or storing or collecting it for any of those purposes, without prior permission from the Museum;
    7. g. Actions linked to criminal behavior or with risks of such a linkage;
    8. h. Actions that disrupt or have risk of disruption the operation of the Service, including, but not limited to, unauthorized access or denial of service attacks or the use of a tool programmed automatically to carry out a certain action repeatedly;
    9. i. Actions that sabotage or obstruct the functions of the server, network, or other infrastructure for the Service;
    10. j. Actions that obstruct the operation or management of the Services, exhibitions, or other operations that the Museum provides;
    11. k. Actions that collect, aggregate, or reuse personal information about other visitors or third parties or information about exhibitions and other Museum programs;
    12. l. Identity theft of an actual person, or pretending to be a nonexistent person, and using a false account;
    13. m. Violating another person’s intellectual property rights, privacy, honor, or reputation;
    14. n. Avoiding, or attempting to avoid, the verification systems and security functions of the Service;
    15. o. Copying, adapting, or altering the Website or analyzing the Website’s source code through reverse engineering or other means;
    16. p. Providing information that is contrary to fact, fictitious, or false;
    17. q. Providing information for research, scholarly studies, or similar purposes;
    18. r. Actions that defame the Museum or the Service;
    19. s. In the use of the Service, actions that violate socially accepted common sense or decency or are otherwise inappropriate;
    20. t. Actions that block the provision or operation of the Service or that defames its honor or reputation;
    21. u. Actions related to the Service that provide, directly or indirectly, benefits to anti-social forces;
    22. v. Other actions that the Museum judges to be inappropriate.
  2. 2. If the Museum has confirmed that a visitor has performed any of the prohibited actions listed in the previous section, it will respond as follows:
    1. a. All timed-entry tickets that the visitor has purchased will be invalidated (whether the prohibited actions involved acquiring those tickets or not) and the visitor will not be permitted to enter the Museum, including its garden, or view its exhibitions. If the visitor has already entered the exhibition gallery or other part of the Museum by using a timed-entry ticket, he or she may be expelled. In these cases, the Museum will not refund the cost of the time-entry ticket and will not be liable for damages caused by the visitor in question.
    2. b. The Museum shall not be liable concerning any conflicts or disputes arising over timed-entry tickets not directly purchased from the Museum.

Article 9. Ceasing to Provide the Service

  1. 1. The Museum may cease or interrupt provision of all or part of the Service, without prior notice to visitors, when it judges that any of the reasons stated below apply:
    1. a. When performing maintenance checks or upgrades on the computer system used in providing the Service;
    2. b. When it has difficulty providing the Service due to force majeure, including, but not limited to, an earthquake, lightning strike, fire, power outage, or infectious disease;
    3. c. When a change, stoppage, delay, or termination, etc., of the telecommunication service provider ’s service has occurred;
    4. d. When the computer or telecommunications line has stopped functioning due to an accident, etc.;
    5. e. When necessary due to unauthorized use or risk of unauthorized use of the Service occurs or to prevent unauthorized use by a third party;
    6. f. Any other reasons for which the Museum judges it unfeasible to provide the Service.
  2. 2. The Museum shall not be liable for any loss or injury that a visitor or third party may suffer from the Museum’s ceasing or interrupting provision of the Service.
  3. 3. The Museum shall not be liable for any problem that might arise if the visitor, while using the Service, turns off his or her browser or stops using the browser for a certain period of time, turns off the computer, or disconnects from his or her network.
  4. 4. The Service is linked to websites and servers outside the Museum.
  5. 5. The Service uses JavaScript, SSL, and cookies.

Article 10. Restrictions on Use

The Museum may, upon concluding that any or all of the reasons stated below apply to a visitor, may restrict that visitor’s use of the Service in whole or part, without prior notice:

  1. a. If the Purchase Information input, as stated in Article 3-2 above, is false, incorrect, or incomplete;
  2. b. If the visitor’s actions disturb the Museum, other visitors, or third parties or obstruct the operations of the Museum or the Service;
  3. c. If the visitor violates the obligation to pay for the timed-entry ticket as stated in Article 5, performs actions prohibited in Article 8, or violates any other clauses of the Terms of Use;
  4. d. If the visitor has defamed the Museum or the Service;
  5. e. If a problem arises in sending an email to the visitor because the email address provided as a part of the Purchase Information does not work or the visitor’s mail service rejects or has faulty reception of email from this source, or other causes;
  6. f. If the Museum has judged that approving the visitor’s use of the Service is not appropriate in terms of the operation and management of the Service.

Article 11. Intellectual Property Rights

  1. 1. All intellectual property rights associated with the Service belong to the Museum.
  2. 2. No information, images, or other material a visitor acquires through use of the Service may be reproduced, copied, distributed, or altered, etc., in whole or in part, beyond the scope permitted under copyright and related laws and regulations of Japan, without receiving the permission of the Museum or other holder of the rights to the information, image, or other material.
  3. 3. Should a dispute over intellectual property rights arise between the visitor and a third party in connection with use of the Service, the visitor shall resolve it at his or her own expense and responsibility. The Museum shall not be liable for any such disputes.

Article 12. Immunity

  1. 1. The visitor, at his or her own responsibility, uses the Service upon a full understanding of the Terms of Use. The Museum shall not be liable should the visitor or a third party suffer a violation or loss of rights to life, health, assets, privacy, or usage of portrait or other rights due to or in connection with the use of the Service or not having used the Service.
  2. 2. Should a time lag, discrepancy, or failure occur in updating the information provided by the Service or in its display or transmission due to human error involving the system or data transmission, the Museum shall not be liable for any resulting damage to the visitor or a third party.
  3. 3. Should a delay or interruption in providing the Service occur due to ceasing or interrupting its provision, as stipulated in Article 9, the Museum shall not be liable for any resulting damage to the visitor or a third party.
  4. 4. Should the Museum restrict use of the Service, as stipulated in Article 10, the Museum shall not be liable for any related damage to the visitor or a third party.
  5. 5. Should the Museum be liable for any reason, its maximum liability shall be limited to the direct and ordinary damages that the visitor in question suffered and shall not include damages such as special damages, indirect damages, lost earnings, impairment of value, lost business opportunities, or loss of reputation.

Article 13. Changes in the Service

The Museum may change the contents of the Service without notifying the visitor and shall not be liable for any resulting damage or loss to the visitor.

Article 14. Ending the Service

  1. 1. The Museum may cease to provide the Service upon informing the visitor at least a month in advance by means the Museum determines.
  2. 2. The Museum shall not be liable for any damage or loss to the visitor as a result of its ending this Service.

Article 15. Cancellation of an Exhibition and Refund by the Museum

If the Museum closes temporarily and an exhibition is cancelled for reasons set out in Section 9.1.b., the Museum may decide to give refunds for the timed-entry tickets for the exhibition in question even after the timed-entry ticket purchase agreement has been completed. In that case, however, no refunds will be given if the timed-entry ticket and/or the Entry QR Code is damaged, lost, or so dirty that it cannot be made out. Refunds apply only to the timed-entry ticket price; any payment settlement fees will not be refunded. Refunds may take three or four weeks to be completed.

Article 16. Changes in the Terms of Use

  1. 1. The Museum reserves the right to alter the Terms of Use at any time without prior notice to the visitor. Displaying the revised Terms of Use on the Website or other website that the Museum operates shall constitute notice to visitors of changes in the Terms of Use. The Terms of Use and any revisions take effect, unless otherwise specified, when displayed as above.
  2. 2. After the notification of changes in the Terms of Use as specified above is made, the visitor is deemed, by using the Service, to have agreed to the revised Terms of Use, unless otherwise specified. The conditions for use of the Service are based on the revised Terms of Use.

Article 17. Notifications or Communications

  1. 1. The Museum may notify the visitor about the Service by means that it determines appropriate, including email, displaying information on the Website or the Museum’s official website.
  2. 2. The notification to the visitor described above is regarded as completed when the information is displayed on the Website or the Museum’s official website or when the Museum has sent an email message to the email address provided by the visitor as a part of the Purchase Information.
  3. 3. Notifications or communications from the visitor to the Museum shall be carried out by the methods the Museum specifies.
